1 Our Services

TrustGate is India’s business review and rating platform. While our primary focus is on Indian businesses and consumers, the platform is accessible globally. Users from anywhere in the world can register a business, submit a review, or report a fraud.

On TrustGate, users can:

• Discover and review businesses, websites, services, and more
• Submit star ratings and written reviews based on firsthand experience
• Report online scams, fraudulent businesses, and deceptive practices
• Register a business to manage its reputation and invite customers to leave reviews

The information provided through our Services is not intended for distribution in any jurisdiction where such distribution would violate local law or regulation. Users who access the Services from outside India do so on their own initiative and are solely responsible for compliance with their local laws.

The Services are not designed to comply with industry-specific regulations such as HIPAA or FISMA. If your use of the platform is subject to such regulations, you should not use the Services for that purpose.

2 Intellectual Property Rights

Our Content and Marks

We own or are licensed to use all intellectual property in the Services, including source code, databases, software, website design, text, photographs, graphics, audio, and video (collectively, the “Content”), as well as all trademarks, service marks, and logos (the “Marks”).

The Content and Marks are protected under Indian and international copyright and trademark law. They are provided through the Services for your personal, non-commercial use only.

Your Use of Our Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable licence to access the Services and to download or print portions of the Content that you have lawfully accessed, solely for personal or internal business use.

You may not copy, reproduce, republish, upload, distribute, sell, or exploit any Content or Marks for commercial purposes without our prior written permission. Any breach of these intellectual property rights will be treated as a material breach of these Terms, and your access to the Services may be terminated immediately.

Your Submissions and Contributions

Submissions: Any feedback, suggestions, or ideas you send to us directly become our property. We may use such submissions for any lawful purpose without compensation or acknowledgment to you.

Contributions: When you post reviews, ratings, reports, comments, or any other content through the Services (“Contributions”), you are solely responsible for that content. By posting Contributions, you confirm that:

• The content is your original work or you have the necessary rights to share it
• The content does not infringe any third-party intellectual property, privacy, or other rights
• You have obtained consent from any identifiable individuals featured in your Contributions
• The content is truthful, accurate, and not misleading
• The content does not violate these Terms or any applicable law

You agree to reimburse us for any losses we suffer as a result of your breach of these warranties. We may remove or edit any Contribution at any time without notice if we consider it harmful, inaccurate, or in breach of these Terms.

3 User Representations

By using the Services, you represent and warrant that:

• All registration information you submit is true, accurate, current, and complete
• You will keep your registration information up to date
• You have the legal capacity to agree to these Terms
• You are at least 18 years of age
• You will not access the Services through automated or non-human means, such as bots or scripts
• You will not use the Services for any illegal or unauthorised purpose
• Your use of the Services will comply with all applicable laws and regulations

If any information you provide is found to be false, inaccurate, or incomplete, we reserve the right to suspend or terminate your account and refuse any current or future access to the Services.

4 User Registration

You may be required to register an account to access certain features of the Services. You are responsible for keeping your password confidential and for all activity that takes place under your account. We reserve the right to remove or change a username that we determine, at our sole discretion, to be inappropriate, offensive, or otherwise objectionable.

5 Prohibited Activities

You may not use the Services for any purpose other than those for which they are made available. In particular, you agree not to:

• Systematically retrieve content from the Services to compile a database or directory without our written permission
• Trick, defraud, or mislead other users, particularly in attempts to obtain account credentials or sensitive information
• Circumvent or interfere with security features of the Services
• Post content that is harassing, hateful, defamatory, obscene, abusive, discriminatory, or threatening
• Use information obtained from the Services to harass, abuse, or harm another person
• Submit false reports of abuse or misuse our support services
• Use the Services in a way that violates any applicable law or regulation
• Upload viruses, malware, or other harmful code that disrupts the Services
• Engage in automated data scraping, mining, or extraction without permission
• Attempt to impersonate another user or person
• Engage in any form of spam, chain letters, or unsolicited mass communications
• Use the Services to compete with us or for any unauthorised commercial purpose
• Delete or alter copyright or other proprietary notices in any Content
• Copy, decompile, or reverse engineer any software forming part of the Services
• Attempt to gain unauthorised access to any part of the Services or related systems

6 User-Generated Contributions

The Services allow you to create and share reviews, ratings, fraud reports, comments, and other content (“Contributions”). Contributions may be visible to other users of the Services and, in some cases, to users of third-party websites.

When you make a Contribution, you represent and warrant that:

• Your Contribution does not infringe any copyright, trademark, trade secret, or other intellectual property right of any third party
• You are the creator of the Contribution or hold the rights necessary to share it
• Your Contribution is not false, inaccurate, or misleading
• Your Contribution is not spam, promotional material, or a pyramid scheme
• Your Contribution is not obscene, violent, harassing, defamatory, or otherwise objectionable
• Your Contribution does not mock, intimidate, or abuse any individual or group
• Your Contribution does not threaten or promote violence against any person
• Your Contribution does not violate any privacy or publicity rights
• Your Contribution does not contain content that exploits or harms minors
• Your Contribution does not include discriminatory language relating to race, religion, gender, national origin, age, sexual orientation, or disability
• Your Contribution does not link to or contain material that violates these Terms or any applicable law

Violations may result in suspension or termination of your access to the Services.

7 Contribution License

By posting any Contribution to the Services, or by linking your account to a social media account to make Contributions accessible through the Services, you grant us a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free licence to use, copy, reproduce, distribute, publish, display, reformat, translate, and create derivative works from your Contributions, in any media format and through any channel, for any purpose including commercial and advertising use.

This licence includes the right to use your name, business name, and any trademarks, logos, or images you provide in connection with your Contributions.

You retain ownership of your Contributions. We do not claim any ownership rights over the content you post. We are not responsible for any statements or representations made in your Contributions, and you agree to hold us harmless from any legal claims arising from your Contributions.

We have the right, in our sole discretion, to edit, re-categorise, or remove any Contribution at any time without notice. We have no obligation to monitor Contributions.

8 Guidelines for Reviews

When submitting a review on TrustGate, you must follow these standards:

• You must have had genuine, firsthand experience with the business, service, or entity being reviewed
• Your review must not contain offensive, profane, racist, hateful, or abusive language
• Your review must not include discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability
• Your review must not reference illegal activity
• You must not post negative reviews about a competitor’s business
• You must not make legal conclusions about the conduct of others
• You must not post false or misleading statements
• You must not organise or coordinate review campaigns, whether positive or negative

We reserve the right to accept, reject, or remove any review at our discretion. Reviews posted on TrustGate are the opinions of their authors and do not represent the views of TrustGate or Pratyasha Fashion Galaxy OPC Private Limited. We are not liable for any claims, losses, or damages arising from any review published on the platform.

9 Social Media

You may link your TrustGate account to third-party social media accounts. By doing so, you confirm that you are authorised to share your social media login credentials with us and that doing so does not violate the terms of service of those platforms.

When you link a social media account, we may access and display content you have stored in that account through the Services. We are not responsible for any Social Network Content and do not review it for accuracy, legality, or appropriateness.

You can disconnect your social media accounts from TrustGate at any time through your account settings or by contacting us. Your relationship with third-party social media providers is governed solely by your agreement with those providers.

10 Third-Party Websites and Content

The Services may contain links to third-party websites or display third-party content. We do not investigate, monitor, or verify the accuracy, reliability, or appropriateness of third-party content, and we are not responsible for it.

Clicking on any third-party link means you leave the Services and do so at your own risk. These Terms no longer apply once you navigate away from the Services. We recommend reviewing the privacy and terms policies of any third-party site you visit. We do not endorse any products or services offered on third-party websites, and we are not liable for any harm or losses arising from your use of or interaction with those sites.

11 Advertisers

We may allow advertisers to display advertisements within certain areas of the Services. We provide the space for such advertising but have no other relationship with the advertisers concerned.

12 Services Management

We reserve the right, but not the obligation, to:

• Monitor the Services for violations of these Terms
• Take appropriate legal action against any user who violates applicable law or these Terms, including reporting them to law enforcement where necessary
• Restrict, suspend, or remove any Contribution or account at our sole discretion
• Remove or disable any content that is excessively large or burdensome to our systems
• Otherwise manage the Services in a manner that protects our rights and the integrity of the platform

13 Privacy Policy

We are committed to protecting your personal data. Please review our Privacy Policy, which is incorporated into these Terms. By using the Services, you agree to the collection and processing of your data as described in the Privacy Policy.

The Services are hosted in India. If you access the Services from a country with different data protection laws, you acknowledge that your data will be transferred to and processed in India, and you consent to that transfer.

14 Copyright Infringements

We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes a copyright you own or control, please contact us immediately using the details in the Contact Us section. Please note that under applicable law, you may be held liable for damages if you make false claims of copyright infringement. If you are uncertain whether material infringes your copyright, we recommend consulting a legal professional before submitting a complaint.

15 Term and Termination

These Terms remain in effect for as long as you use the Services. We reserve the right to deny access to the Services to any person, at any time and for any reason, without notice or liability. This includes blocking IP addresses and terminating accounts where we determine that a breach of these Terms or applicable law has occurred.

If your account is terminated or suspended, you must not attempt to re-register under your own name, a false name, or the name of any third party. We reserve the right to pursue appropriate civil, criminal, or injunctive remedies in connection with any such breach.

16 Modifications and Interruptions

We may change, update, or remove content from the Services at any time without notice. We do not guarantee that the Services will be available at all times. Scheduled or unscheduled maintenance, technical failures, and other events may result in temporary downtime or interruptions. We are not liable to you for any loss or inconvenience arising from downtime or changes to the Services.

17 Governing Law

These Terms are governed by the laws of India. Pratyasha Fashion Galaxy OPC Private Limited and you both consent to the exclusive jurisdiction of the courts of India for the resolution of any disputes arising from or relating to these Terms.

18 Dispute Resolution

All disputes related to these Terms or your use of the Services shall be submitted to the jurisdiction of the Indian courts. We also reserve the right to bring proceedings in the courts of the country where you reside, or, if these Terms were entered into in the course of a trade or profession, in the courts of your principal place of business.

19 Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any such errors and to update or change information at any time without prior notice.

You agree to defend, indemnify, and hold harmless Pratyasha Fashion Galaxy OPC Private Limited, along with its affiliates, officers, agents, partners, and employees, from any loss, damage, liability, or claim (including reasonable legal fees) arising from: (1) your Contributions; (2) your use of the Services; (3) your breach of these Terms; (4) your breach of any representations or warranties in these Terms; (5) your violation of any third-party rights, including intellectual property rights; or (6) any harmful act you take against another user of the Services.

We reserve the right to assume the exclusive defence of any matter for which you are required to indemnify us, at your expense. You agree to cooperate with our defence of any such claims.

23 User Data

We store certain data you transmit to the Services in connection with your use of the platform. While we perform routine backups, you are solely responsible for your data. We are not liable for any loss or corruption of data, and you waive any right of action against us in connection with such loss or corruption.

24 Electronic Communications

By using the Services, sending us emails, or completing online forms, you consent to receiving electronic communications from us. You agree that all notices, disclosures, agreements, and other communications provided electronically satisfy any legal requirement that such communications be made in writing. You also agree to the use of electronic signatures and electronic records in connection with your use of the Services.

25 Grievance Redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection Act, 2019, we have designated a Grievance Officer to address complaints and concerns from users.

We will acknowledge all grievances within 48 hours of receipt and aim to resolve them within 30 days.

If your complaint is not resolved to your satisfaction, you may approach the appropriate consumer forum or contact the National Consumer Helpline at 1800-11-4000 (toll-free) for further assistance.

26 Miscellaneous

These Terms, together with our Privacy Policy and any other policies posted on the Services, constitute the entire agreement between you and us regarding your use of the Services. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in full force and effect.

We may assign our rights and obligations under these Terms to any party at any time. No joint venture, partnership, employment, or agency relationship exists between you and us as a result of these Terms.
